Chapter 13 Bankruptcy

Chapter 13 BankruptcyYou work hard to keep your finances in order, pay your bills, and support your family in Colorado. But, sometimes, despite this hard work and planning, a financial situation can crumble and you’re left scraping by and suddenly unable to fully cover life’s expenses.

Landing in this situation can be frightening, and confusing. You may be asking: how will I pay my mortgage? My car payments are piling up and I’ve been getting calls from a debt collector, how do I keep my property if I can’t pay off these debts right now? All of this can seem overwhelming, and it is, but you don’t have to figure it out on your own. There are options for getting rid of debt without foreclosing your home or losing your car.

Filing for a Chapter 13 bankruptcy could be the answer you need. Filing for bankruptcy may not be your ideal option, it may not even be your best option, but it is an option that you can discuss with an experienced bankruptcy attorney that can rid you of debt.

A Chapter 13 bankruptcy includes a payment plan set up between 3 to 5 years, and during that time you pay back all or a portion of the debts. What’s beneficial about a Chapter 13? You get to keep all of your property.

In order to be eligible for a Chapter 13, you must prove to a court that you will be able to meet your payment obligations during the payment period. If your income is inconsistent or too low, then you may not be able to file for this type of bankruptcy — if bankruptcy is truly your best option. Also, eligibility to file for Chapter 13 depends on your total secured and unsecured debt.

All of these aspects — determining your debt, what options are best for you, setting up a payment plan, and presenting your situation to the court — are aspects that are made more manageable by having a practiced bankruptcy attorney help you every step of the way. This is where I come in.

I’m a licensed bankruptcy attorney with more than 28 years of experience serving clients in Colorado, and I am here to help you. We can sit down and discuss whether bankruptcy is the right solution to your financial debt, and which bankruptcy might be right for you.  If a Chapter 13 bankruptcy is a viable option for you, I will help set up a manageable payment plan based on your income, which is one of the most important facets of this type of bankruptcy. Any questions you have, I will answer.

My goal is to make your financial future brighter, with as little damage to you and your family as possible. If you’re considering filing for bankruptcy, or have questions about bankruptcy, don’t hesitate to contact The Law Office of Chris D. Hefty.

I’ve served clients in Loveland, Larimer County, Fort Collins, Greeley, and throughout Northern Colorado. Call to find out if I can help you, too.
